Child Custody (a/k/a Parenting and Time-Sharing)

In 2008, Florida removed the term “Custody” from its statutes in favor of terminology of “Parenting and Time-Sharing.” Despite the change in the language within the laws, many people still refer to “Parenting and Time-Sharing” in terms of “custody.” As much of the population refers to the responsibilities associated with making decisions for, caring for, and having time with child(ren) as “custody,” the issues related to parenting and time-sharing will be collectively referred to as child custody throughout this site.

Child custody is often the most difficult issue of any family law proceeding. Because the outcome could possibly impact your relationship with your child(ren) for the rest of your life, very few family law cases are as personal or potentially damaging as a child custody case. Mrs. Darley is sensitive to the needs of child(ren) and works hard to achieve results that are best for the child(ren). Mrs. Darley has the skill and understanding to assist families in reaching resolutions to these highly emotional and sensitive matters.

Mrs. Darley works hard to resolve the issues concerning parental responsibilities and duties, time-sharing, and other child-related issues. It is important for all parents to understand that should they not be able to resolve those matters together, a Florida Family Law Judge will make the determination for them. As such, Mrs. Darley helps to facilitate and highly encourages the parents to work together to decide their child(ren)’s future.

In the event the parties cannot decide their child(ren)’s future for themselves, the judges of Florida will make that determination for them based upon what is in the best interests of the child(ren). The best interests of the child(ren) are dictated by statutory factors and case law precedent. The best interests of the child(ren) may include properly presenting information to the Court including information about a parent’s anger management issues, problems with addiction, and the child’s needs. Regardless of whether Mrs. Darley is helping you to reach an agreement or present your case to the Court, Mrs. Darley will always work hard to advocate for your child(ren) and their best interest.
